Job Title: Patent/Intellectual Property Litigation Associate

Job Summary: As a Patent/Intellectual Property (IP) Litigation Associate, you will specialize in providing legal support and representation to clients involved in disputes related to patents, trademarks, copyrights, and trade secrets. Working within a dynamic legal team, you will assist in all aspects of IP litigation, from case analysis and legal research to trial preparation and courtroom advocacy.

Responsibilities:

  1. Case Analysis: Conduct thorough analyses of intellectual property disputes, including patent infringement, trademark dilution, copyright infringement, and misappropriation of trade secrets. Evaluate the strengths and weaknesses of clients' positions and provide strategic recommendations.

  2. Legal Research: Perform in-depth legal research on relevant statutes, regulations, case law, and industry standards to support case strategies and develop persuasive legal arguments. Prepare memoranda, briefs, and other legal documents outlining legal positions and recommendations.

  3. Discovery Management: Assist in managing the discovery process, including drafting and responding to discovery requests, conducting document reviews, preparing for and attending depositions, and coordinating with expert witnesses.

  4. Claim Construction: Participate in claim construction proceedings in patent cases, including analyzing claim language, preparing claim charts, and assisting in the drafting of claim construction briefs and related motions.

  5. Trial Preparation: Collaborate with senior attorneys to prepare for trials, hearings, and other court proceedings. Assist in developing trial strategies, preparing witnesses for testimony, organizing trial exhibits, and drafting trial-related motions and briefs.

  6. Courtroom Advocacy: Attend court hearings, trials, arbitrations, and mediations, and assist in presenting oral arguments, examining witnesses, and making legal presentations before judges, juries, and arbitrators.

  7. Client Communication: Maintain regular communication with clients to provide updates on case developments, address inquiries, and manage expectations. Work closely with clients to understand their business objectives and tailor legal strategies to align with their goals.

  8. Settlement Negotiations: Participate in settlement negotiations with opposing parties and their counsel to explore opportunities for resolving disputes outside of court. Assist in drafting settlement agreements and evaluating proposed settlement terms.

Qualifications:

  1. Juris Doctor (J.D.) degree from an accredited law school.
  2. Admission to the state bar and in good standing with the relevant jurisdiction.
  3. Strong academic credentials, with a focus on intellectual property law coursework preferred.
  4. Previous experience in patent litigation, trademark litigation, or other IP-related disputes highly desirable.
  5. Technical background or familiarity with scientific and technological concepts relevant to patent litigation preferred.
  6. Excellent research, writing, and analytical skills, with the ability to communicate complex legal and technical concepts effectively.
  7. Proficiency in legal research tools and databases, such as LexisNexis, Westlaw, and the United States Patent and Trademark Office (USPTO) database.
  8. Detail-oriented with exceptional organizational and time management abilities.
  9. Ability to work both independently and collaboratively in a fast-paced, team-oriented environment.
  10. Commitment to professionalism, integrity, and client service excellence.

 
Seeking an entry level associate and an associate with 3+ years of experience. 
 
Candidates should possess a technical background, preferably in electrical engineering, computer science, or related field, for our patent and other intellectual property litigation practice.
